The Virtual Terminal free rental promotion is only open to businesses defined herein.
Promotion Description
The Virtual Terminal free rental promotion is an offer to allow Eligible Merchants to use an EVO Virtual Terminal for a period of 6 months on a Tailor Made price plan. At any time within the first 6 months you can cancel your Virtual Terminal without incurring any early termination penalties. For each of the first 6 months contractual transaction fees apply but the rental fee of £20 per month will be waived. At the end of the 6 month period the standard £20 monthly rental fee (together with any right of modification) will be applied for the remainder of your relationship with EVO.
Eligibility
The promotion is only available to Eligible Merchants. You are only eligible to participate in this promotion if you meet the eligibility criteria set forth in these terms and conditions and accept these terms and conditions in the manner set forth herein. EVO reserves the right to verify the eligibility of all early termination requests and may at its sole discretion, refuse to waive the early termination charges if the customer fails to satisfy eligibility requirements or gives false or misleading information.
Terms and Conditions
Defined terms
‘Eligible Merchant’ means any new EVO merchant or an existing EVO merchant who is not currently using a Virtual Terminal and who is operating under a Tailor Made price plan.
‘Participant’ or ‘you’ means you, and EVO merchant.
‘Processor’ means EVO Payments International GmbH, trading as EVO Payments UK.
‘Tailor Made’ A pricing plan that allows for per-transaction charging (e.g. not a Ready-Made flat monthly fee pricing).
‘Virtual Terminal’ A web page that can work stand-alone or be integrated with Merchant’s own back end (or back office) applications in order to facilitate Card Not Present solutions.
General terms
The promotion is not available to Participants that are otherwise ineligible for Processor’s services for Card Not Present transactions.
The promotion structure is subject to modification or limitation at any time, with or without notice, in Processor’s sole discretion, including, without limitation, the right to establish additional conditions for eligibility.
Participant agrees to be bound by these terms and conditions, and represents and warrants to processor that all information provided is accurate, up-to-date and complete.
Processor reserves the right to modify or terminate the promotion and these terms and conditions at any time without prior notice.
Processor reserves the right to totally or partially cancel or change the promotion, with or without prior notice.
Processor reserves the right to approve, deny or revoke participation in the promotion to any merchant for any reason whatsoever.
Processor will use reasonable efforts to ensure that sufficient prior warning is given should the promotion be cancelled, but will not be responsible for any losses or damages caused by its cancellation or modification.
Miscellaneous
These terms and conditions and the promotion will be interpreted, construed and enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the Ireland. Any claim, action, lawsuit, proceeding, or cause of action arising under or relating to these terms and conditions and/or the program will be brought exclusively in a court in the United Kingdom.
